Roadside exercises and officer observations may be part of the probable-cause record. The legal significance depends on the jurisdiction, the complete encounter, and how the tests were administered and documented.

Records to locate

  • Officer narrative.
  • Body-camera or dash-camera video when available.
  • Exact test names noted in the report.
  • Roadway, lighting, weather, footwear, and medical facts documented in the file.
  • Officer training/certification records if lawfully discoverable and relevant.

Questions for counsel

  • Which observations are actually relied on in the charging or probable-cause theory?
  • Does the video match the written report?
  • Are medical or mobility limitations documented?
  • What local evidentiary rules govern the use of the tests?
